to wear seat belts. According to Cal/OSHA
regulations, CCR§
3653(a) "where roll over protection structures (ROPs) are installed, seat belts must
be provided and employees must be instructed in their use". Section 3651(a) requires ROPs specifically for "agricultural and industrial tractors manufactured after October 25, 1976. There is no requirement for ROPs on forklifts (industrial trucks). The cage around the forklift is typically for falling object protection only and generally offers no rollover protection. Unless the vehicle specifically indicates that the cage meets ASAE or SAE requirements for rollover protection, it is not considered ROP. This is typically stamped in a conspicuous location on the cage. Only some forklifts meet this requirement. According to representatives from the Cal/OSHA Research and Standard Development Unit, Cal/OSHA has considered requiring the use of seat belts on forklifts. Cal/OSHA's approach thus far is to recommend that employers follow manufacturer's recommendations. Most manufacturers recommend the use of seat belts even in the absence of ROP; it is their contention that seat belts provide increased protection in case of a forklift tipping or rolling over. In most rollover accidents where the operator fell out of the seat, they were crushed by the cage. It is our understanding, per discussion with Cal/OSHA that they will not issue citations if the driver does not use the seat belt unless the vehicle is equipped with roll over protection. The Cohen Group recommends however, where seat belts are provided on forklifts, their use by forklift operators should be strongly encouraged.
